Tentative Rulings

Tentative Rulings

Tentative rulings are proposed decisions made by judicial officers prior to a law and motion hearing, advising parties of how the court intends to rule if the parties do not elect to make oral arguments. However, tentative rulings are made for all matters in Probate.

If all parties agree to the court's tentative ruling, that ruling will become the order of the court. The prevailing party or counsel shall prepare an appropriate order within five (5) court business days and submit it to the other party for approval as to form. The order shall then be submitted to the court for signature.

If any party wishes to appear for oral argument, that party must:

  1. Telephone all other parties or their attorneys by 4:00 p.m. the day before the scheduled hearing date. It is not necessary to speak directly with counsel or the other parties; it is all right to leave a message.
  2. Then, immediately advise the law and motion clerk by leaving a message no later than 4:00 p.m. the day before the scheduled hearing at (415) 444-7046, option 5.
  3.  For Probate matters, any interested party who wishes to appear for oral argument on the tentative ruling must do the following no later than 4:00 PM one Court day prior to the scheduled hearing date (MCR 6.2.D):
    a.  Notify all other parties entitled to notice of the underlying petition, including the attorneys for represented parties; and
    b.  Advise the clerk’s office by leaving a message at (415) 444-7046, option 5

PLEASE NOTE: If proper notification of all parties and the court is not made by the 4:00 deadline, no oral argument will be permitted and the tentative ruling will become the order of the court. This process does not apply to Probate matters
